This Privacy Notice describes our practices with respect to the personal information we collect through our Website and marketing activities. This Privacy Notice does not apply to any personal information that Netpreme processes on behalf of its customers as part of customer workload data (“Customer Data”) through our XM-Serve inference platform and related services (the “Services”). The processing of personal information contained in Customer Data is governed by our Terms of Service, our Services Privacy Notice available at https://api.netpreme.com/console/privacy, and our Data Processing Addendum (“DPA”) available at https://api.netpreme.com/console/privacy#dpa.

When Netpreme processes personal information contained in Customer Data on behalf of its customers, Netpreme acts as a data processor (or service provider, as applicable under relevant privacy laws) and processes such data solely in accordance with its customers’ instructions and the terms of the applicable customer agreement. Our customers are the data controllers (or businesses, as applicable) who determine the purposes and means of processing Customer Data, and our processing of Customer Data is governed by our DPA, which forms part of our customer agreements. Netpreme is the data controller (or business, as applicable) with respect to business contact information and customer account information collected in connection with account registration, authentication, billing, support communications, and service administration, and the processing of such data is governed by this Privacy Notice and our Services Privacy Notice.

If you are an end user whose personal information is processed by Netpreme on behalf of one of our customers, please direct any data privacy inquiries or requests to the applicable customer, as they are the controller of your personal information.

When we use the term “personal information,” we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified, so that it cannot identify or be reasonably linked to you. We may collect or process the following categories of personal information, including inferences drawn from this personal information, depending on how you interact with the Website, where you live, and as permitted or required by applicable law:

• Contact details including your name, address, phone number, and email address.
• Communications with us including the information you include in communications with us, for example, when sending a customer support inquiry.
